Terms of Service

1.1 This ToS sets out the terms on which PolicyPal provides its services to you in handling any and all matter(s) relating to the Website and Services. This ToS shall include all supplements, additions, amendment and variations thereto, and shall be read together with PolicyPal's Privacy Policy and any other agreement(s) that you agree to be bound by in the course of your use of the Website. If there is any conflict between any of these agreements, the latest of the agreements into which you have entered shall take precedence.

1.2 This ToS shall be effective immediately upon your acknowledgment of it, and shall continue in perpetuity unless terminated by either Party in accordance with this ToS.

From time to time, PolicyPal may keep you updated on the progress of the Services of this ToS. These will be by e-mail or telephone. You should similarly keep us updated by e-mail or telephone of all developments and changes surrounding the circumstances of the Services.

3.1 On PolicyPal’s side, to facilitate efficient communication between PolicyPal and you, we will identify the points of contact and the preferred mode for communication together with complete contact details as provided by you.

3.2 On your side, unless you otherwise inform us, we will communicate with any person who is, or appears to be from the office or institution by which we were initially contacted, unless you specifically request otherwise.

4.1 In order to use our Services, you must register on the Website as a natural person above 18 years old and residing or domiciled in Singapore.

4.2 You acknowledge that all registration information provided by you is complete and accurate as at the time of registration, and that you will update the said information, from time to time, should any change occur.

4.3 PolicyPal may, at its full discretion, at any time, revoke your user registration request in the event it finds you have violated the above registration requirements.

4.4 You are responsible, at all times, for the safekeeping of your registration information and all further information in relation to your insurance policy that is available on your profile. You agree to provide us with immediate notice in the event you suspect that there has been misuse of your data.

5.1 As a registered user, you authorise PolicyPal to manage your insurance policy in accordance to the Services. You acknowledge that PolicyPal does not and will not provide you with any advice, review, or recommendation in relation to your insurance policy.

5.2 In carrying out its Services, PolicyPal works as follows:

  1. You will grant PolicyPal permission to request or retrieve any and all information from your insurance company in relation to your policy, including access to Third Party Systems;
  2. PolicyPal will then use the above information to formulate a visual chart breakdown of your policy, which will be available on the Website;
  3. You will thereafter be able to amend or optimize your insurance policy by requesting for review(s) from the licensed financial adviser(s) listed on the Website. In doing so, you will be required to provide further information, such as a list of your assets and liabilities. The review(s) will then be transmitted by PolicyPal to you via the Website; and
  4. You are thereby able to compare the review(s) on PolicyPal and select the most suitable insurance for you. You then enter your chosen insurance by contracting directly with the insurer(s) via the Website. The insurance contract will be added to your profile whereby all relevant and important information in relation to the above will be available to you on the Website at all times.

5.3 Based on the Services as described above, you acknowledge that:

  1. the insurance recommendations are based on the best and most sensible option from the review(s) provided to you, and that you are not obligated to enter into the suggested insurance contract(s); and
  2. the review(s) provided to you on the Website do(es) not replace the review(s) acquired from any existing consultation or advisory service that you have in relation to your insurance policy. We advise that you seek independent advice should you require further review(s) and/or recommendation(s) than that already provided for you on the Website;

You agree not to obtain or attempt to obtain unauthorised access of the Website, or to any protected information, through any means not intentionally made available by PolicyPal for your specific use.

PolicyPal may, at any time, without prior notice, provide updates to the Website for the purposes of technical repair, software maintenance, or to improve its Services as a whole. This may result in a temporary disruption and/or denied access to the Website, which PolicyPal will not be liable for.

Notwithstanding the above, PolicyPal is also not liable for any loss of data or consequential damage as a result of the temporary disruption.

7.1 The Website may contain, and/or the Services may provide, links to other websites or content on the Internet that are owned or operated by third parties. Unless PolicyPal expressly says otherwise, you should assume that these other websites are not under the control of PolicyPal. We assume no responsibility and shall not be liable for any errors or other consequences arising from accessing or delays in accessing such websites or content or any actions taken in reliance thereon, and we disclaim liability for any and all forms of loss or damage arising out of the use of those websites and their content.

7.2 Under no circumstances shall it be construed that, in case of your access to and use of the Third Party Systems, PolicyPal is a party to any transaction, if any, between you and such third party.

7.3 You acknowledge and agree that you will be solely responsible for any access to or any use of Third Party Systems through the Website or Services. If you access or use any Third Party Systems through the Website or Services, you must comply with the relevant terms and conditions of the access or use of such Third Party Systems, and be responsible for the registration and use of any user names or passwords required to connect to any Third Party Systems.

You agree not to obtain or attempt to obtain unauthorised access of the Website, or to any protected information, through any means not intentionally made available by PolicyPal for your specific use.

9.1 All Trade Marks are registered and unregistered trademarks of PolicyPal, its related corporations and/or third parties. Nothing on this Website should be construed as granting, by implication, estoppel or otherwise, any licence or right to use any Trade Marks displayed on the Website, without the written permission of PolicyPal or any other applicable trade mark owner. The name of PolicyPal may not be used in any way without its prior written permission.

9.2 All of the Content is the property of our licensed by PolicyPal, its related corporations, and/or third parties with whom it does business, and is protected by the relevant intellectual property laws of Singapore

9.3 You may not reproduce, republish, copy, display, broadcast, hyperlink, mirror, frame, transfer, transmit, distribute, store or in any other fashion re-use the Content in any manner or by any means unless otherwise indicated on the Website or unless given express written permission by PolicyPal to do so.

9.4 Permission will be granted to you to download, print or use the Content, and to create links to the Content for personal, non-commercial purposes, provided that you do not modify the Content and that you do not attempt to revise, remove, or appropriate all copyright and other proprietary notices contained in the Content.

10.1 Save as provided for in this ToS, PolicyPal undertakes, in the course of providing the Services, not to use, divulge or allow to be used or divulged to anyone, any confidential and privileged information belonging to you, that you provide as a registered user on PolicyPal.

10.2 Notwithstanding the above, PolicyPal cannot guarantee the confidentiality of such data, as it may be lost during transmission, or changed, or accessed by unauthorized third parties.

You agree to indemnify and hold harmless PolicyPal, and its Indemnified Persons handling or otherwise providing the Services from and against any and all claims, actions, demands, proceedings, liabilities or judgments, and against all losses, taxes, expenses, costs, legal fees, and liabilities (present, future, contingent or otherwise on an indemnity basis), which may be suffered or incurred by any of the Indemnified Persons as a result of or in connection with a breach of this ToS in connection with the Services.

12.1 You agree to be solely responsible for your operations in acting under this ToS, including, without limitation, the legality of your operations and materials created and used in connection with this ToS.

12.2 Neither PolicyPal nor any Indemnified Person shall be liable in contract, tort (including negligence or breach of statutory duty) or otherwise, for (i) any loss of profit, business or revenue, (ii) any costs or expenses, or any special, indirect or consequential damages of any nature whatsoever, suffered or incurred by you as a result of or in connection with the provision of the Services, except to the extent that the final judgment of a court of competent jurisdiction holds it to have resulted directly and solely from the wilful default or gross negligence of the relevant Indemnified Person in performing its Services.

13.1 Either Party may terminate this ToS for any or no reason, upon 30 days’ prior written notice to the other Party, provided, however, this ToS may be terminated by PolicyPal immediately in the event you have breached this ToS and/or any terms or conditions applicable to the Website and/or the Services, or otherwise harmful for PolicyPal or its users. Both Parties agree the opportunities presented by this ToS constitute adequate consideration for such a termination right.

13.2 You acknowledge that such termination will result in your user account being deleted and that we may retain the information contained therein for purposes including, but not limited to, marketing, analytics, or to comply with applicable laws.

13.3 Neither Party shall be liable for any damages resulting from the termination of this ToS, provided, however, the termination of this ToS shall not affect any claim arising prior to such termination.

13.4 Each Party shall be responsible for its own expenses relating to any such termination.

13.5 The termination of this ToS shall not affect the term, validity or enforceability of any separate agreement between both Parties in effect as of the date of termination of this ToS, including any other PolicyPal agreement entered into by you. All obligations under this ToS of a continuing nature shall survive termination.

No person has any right under the Contracts (Rights of Third Parties) Act (Cap. 53B) of Singapore to enforce any provision of this ToS.

No party may assign any of its rights, or delegate the performance of any of its duties, under this ToS, without prior written consent of PolicyPal.

A failure or delay in exercising any right, power or privilege in respect of this ToS will not be presumed to operate as a waiver, and a single or partial exercise of any right, power or privilege will not be presumed to preclude any subsequent or further exercise of that right, power or privilege or exercise of any other right, power or privilege.

All notices between both Parties provided for or permitted under this ToS or by law shall be in writing and shall be deemed duly served when (i) delivered, if delivered by courier or other messenger (including registered mail) during normal business hours of the recipient; (ii) when sent, if transmitted by fax or e-mail; (iii) on the fifth business day following mailing, if mailed by national ordinary mail, postage prepaid; or (iv) on the tenth business day following mailing, if mailed by airmail, postage prepaid; in each case addressed to the most recent address, e-mail address, or facsimile number notified to the other Party.

18.1 This ToS will be governed and construed in accordance with Singapore law.

18.2 With respect to any Proceeding, each party submits to the non-exclusive jurisdiction of the courts of the Republic of Singapore.

19.1 This ToS constitutes the entire agreement of the Parties relating to the provisions set out in this ToS. This ToS supersedes all prior communications, contracts, or agreements, written or oral, agreements between the Parties with respect to any provisions set out in this ToS.

19.2 In the event any provisions of this ToS are found to be or become unlawful, invalid or otherwise unenforceable, that provision is deemed severed from this ToS and shall not affect the legality, validity and enforceability of the remaining provisions of this Tos, and shall continue in force as if such unlawful, invalid or unenforceable provision was severed from this ToS.

19.3 Any failure or delay by you or PolicyPal in exercising or enforcing any rights or remedy contained in this ToS does not constitute a waiver by the Party responsible for such delay or failure. It shall also not constitute a bar to the exercise or enforcement at any subsequent time or times. Waiver of any right arising from a breach or non-performance of this ToS or arising upon default under this ToS shall be in writing and signed by the Party granting the waiver.

19.4 In this ToS, any reference to any legal entity or individual person includes, where appropriate, a reference to its authorised agents, delegates, successors or nominees. Expressions in the singular form include the plural and vice versa.

19.5 No rule of law (or interpretation to the effect) that an ambiguity in a document is to be construed against the party drafting or preparing such document shall apply in respect of this ToS.

19.6 Any reference to any law, statute or regulation or enactment shall include references to any statutory modification or re-enactment thereof, or to any regulation or order made under such law, statute or enactment (or under such a modification or re-enactment).

19.7 The headings used in this ToS are for convenience of reference only and are not to affect the construction of, or to be taken into consideration in, interpreting this ToS.
